Terms of service
Scope
These General Terms and Conditions (“T&C”) apply to the use of the NÉMOIR website and to all business relationships between NÉMOIR GmbH, Sankt Alban-Rheinweg 210, 4052 Basel, Switzerland, and its customers with residence in Switzerland.
A customer is any natural or legal person who enters into a business relationship with NÉMOIR.
NÉMOIR reserves the right to amend these T&C, the delivery and payment terms, as well as the data protection provisions at any time. The version valid at the time of the order shall apply. By placing an order or using the website, the customer accepts the current version of these T&C.
Information on the Website
NÉMOIR provides information on products and services on its website. Changes to the product range, prices, materials, colours, cuts, and technical specifications are reserved.
Images, measurements, and descriptions are for guidance only and are non-binding. All offers are subject to change. Information on availability and delivery times is provided without guarantee and may change at any time.
Prices
All prices are stated in Swiss Francs (CHF) and are net prices, excluding statutory value-added tax (VAT), unless stated otherwise.
Additional shipping costs are shown separately during the ordering process and are borne by the customer unless expressly stated otherwise.
Price changes, errors, and printing mistakes are reserved.
Conclusion of Contract
Orders placed via the NÉMOIR website are binding. By submitting an order and accepting these T&C, the customer makes a legally binding offer.
The purchase contract is concluded once NÉMOIR confirms the order by email.
Delivery is generally made only after full payment has been received (except for purchase on invoice, if offered).
If a product is not available or not fully available, NÉMOIR reserves the right to withdraw from the contract in whole or in part. Any payments already made will be refunded in such cases.
Payment Methods & Retention of Title
The available payment methods are displayed during the ordering process. NÉMOIR reserves the right to exclude certain payment methods or to require advance payment.
The delivered goods remain the property of NÉMOIR until full payment has been received.
Delivery, Inspection Obligation & Returns
Delivery is made by post or courier service to the delivery address specified by the customer.
Risk and benefit pass to the customer upon dispatch of the goods.
The customer is obliged to inspect the delivery immediately upon receipt and to notify NÉMOIR in writing of any defects or discrepancies without delay.
Returns are made at the customer’s expense and risk, unless expressly agreed otherwise.
Right of Withdrawal
The customer has the right to withdraw from the contract within 14 calendar days of receiving the goods.
Returned items must be:
- unworn,
- complete,
- in their original packaging,
- and returned together with the delivery note.
The costs and risk of return shipping are borne by the customer.
After receipt and inspection of the goods, any payments already made will be refunded within 20 days. NÉMOIR reserves the right to deduct an appropriate amount from the refund in the event of signs of use, damage, or loss of value.
The right of withdrawal does not apply to:
- personalised or custom-made items,
- products that cannot be returned for hygiene reasons.
Liability
To the extent permitted by law, NÉMOIR excludes all liability for direct or indirect damages.
Liability for intent or gross negligence, as well as mandatory statutory liability provisions, remain reserved.
Data Protection
NÉMOIR processes personal data exclusively for the purpose of contract execution and, where permitted, for its own marketing purposes.
Data may be passed on to carefully selected service providers (e.g. logistics or payment service providers) insofar as this is necessary for the fulfilment of the contract.

Final Provisions
NÉMOIR reserves the right to amend these T&C at any time. Swiss law shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel (Switzerland), insofar as legally permissible.
